1. The Club
A - The club is a proprietary club owned by School House Leisure Ltd. (the company) whose principal objective is to provide a lifestyle choice for its members. The company has appointed Club Manager(s) who together with the Directors are responsible for the operation of the club in accordance with these Rules as amended from time to time.
A - Membership is subject to the rules and regulations of the club.
B - Membership is for a minimum initial period of 3 or 12 months. (The contract period) following this minimum period the Member must observe the termination clause set out in 6.c herein.
C - The management reserves the right to reject an application for Membership to the club without giving its reasons for doing so.
D - Membership is personal to the member and is non-assignable.
E - Only those members on the Made Wellness & Spa package have off peak use of Moddershall Oaks facilities.
F - Joint memberships are available, but would apply only to those living at the same address (proof required) and the joint tariff would be taken from one bank account. Joint membership is only available on 12 month contracts.
G - The management reserve the right to revise prices, discounts and incentives at any time without prior notice (notice is given for changes to tariffs).
H - After the initial period of 3 or 12 months. (The contract period) following this minimum period the membership would then revert to a rolling month contract and the Member must observe the termination clause set out in section 6.
A - Membership dues are payable in advance; annually or monthly by direct debit on the first of every month.
B - Where date of joining is after the 10th of the month the rest of that month plus the following month will either be collected at the time of joining or added onto the first direct debit payment amount.
C - Membership dues may be increased, subject to 45 days notice, at the discretion of the management.
D - If your membership tariffs increased whist you are within your initial contract period, your tariff will remain unaffected until the first months subscription outside the initial contract period. At the time it will automatically be increased to the new amount by us unless you have notified us of your 30 days notice to cancel in writing.
E - Prior to completion of a 12-month membership it is the members responsibility to advise how they would like to proceed with regards to the renewal of their membership. This must be actioned 30 days preceding the completion date of the contract. Failure to do so will result in an automatic renewal on to the rolling membership pricing applicable at the time of switch over.
A - In consideration for the management accepting his/her application for membership of the club and for he/she becoming and remaining a Member of the club, the Member agrees that: i Neither the company, nor its employees or agents shall be liable for any loss, damage or theft of any property belonging to, or brought onto the club premises unless caused by negligence of the management, employees or agents of the company. ii Neither the company, nor any employees or agent of the company shall be responsible for any death, personal injury or illness occurring upon the club premises or as a result of the use of the facilities and/ or equipment provided by the club, except to the extent that such death, personal injury or illness arises from any negligent act or omission of the company or its employee or agent.
5. Physical Condition of MemberA - The member warrants and respects that he/she is in good physical condition that he/she knows of no medical or other reason why he/she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
B - The member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members, guests and employees.
A - The management may terminate the membership of any member: i Without notice and with immediate effect if the members conduct, whether or not such conduct is the subject of complaint by another member is such that in the reasonable opinion of the company, it may be injurious to the character or interests of the club or is such that it renders the member unfit to associate with other members of the club. ii Without notice with immediate effect if the member shall have committed any breach of these terms and conditions or of the rules and regulations of the club as are from time to time in force. iii If any part of the initial subscription fee or the monthly membership charge which is due & payable remains unpaid after the payment due date. iv Upon notice in writing, if the company is of the opinion that, the member is not a suitable individual for continued membership of the club. v All decisions of the management under this clause are final and binding.
B - Any member whose membership is terminated shall forfeit all the privileges of membership with immediate effect. No refunds of membership charges will be given, and the member shall settle any outstanding debits.
C - Any member can cancel their Membership following the initial 3 or 12 month contract period covered by this agreement, by giving 30 days written notice, such notice will take effect from the 1st of the month. All subscriptions and dues must be fully paid up to date at the time of cancellation.
D - New members will be given a 14 day cooling off period starting the day after the membership has started whereby they can cancel without notice or reason. A full refund will be granted with the exception of the cost to cover any services provided up until you cancel.
E - The company may close or withdraw the provision of its membership offering at any time. Members will receive two months written notice of intention to do so. The company shall reimburse any membership fees it has taken, that relate to the period post-closure.
A - Made memberships are available for people aged 16 years and over however we will be offering a range of family classes, childrens workouts and our healthy café is family friendly.
B - Made offers baby changing facilities.
C - For those members on a Made Wellness & Spa contract, Moddershall Oaks operates an adult friendly policy. Members and guests are therefore respectfully asked not to bring children under 16 to the premises at any time.
A - Appropriate clean clothing must be worn at all times in the Club (and during exercise unless specifically otherwise advised by a staff member).
B - Appropriate footwear must be worn throughout the club as advised by an instructor.
A - All reservations for classes may be made in advance subject to full pre-payment being made for anything that isn't already included within your membership package. A minimum 12-hours notice is required to cancel a reservation. If shorter notice is given, the Member who made the reservation will be charged in full unless the booking can be re-booked to someone else.
B - The management reserve the right to refuse to re-book a member who repeatedly cancels or fails to keep appointments for services, events or classes.

A - Members and guests should use the equipment and facilities in accordance with the advice given by club staff and/or by notices suitably posted. Members and guests shall not abuse the equipment or facilities of the club and a member or guest who wilfully or negligently causes such damage shall pay for any damage to club property.
B - Disorderly, rude or offensive behaviour will result in the termination of membership and for the purpose of this rule a single breach will be regarded as serious.
C - No member or guest shall bring intoxicating liquor or food into the club
D - Smoking is only permitted within designated outdoor smoking areas.
E - In the interest of health and hygiene, all club users are requested to shower prior to entering any pool, sauna or steam room
F - Members or guests may not use the facilities of the club whilst under the influence of alcohol, narcotics or other mood altering substances.
G - Members and their guests use the club, swimming pool/ spa area which are not supervised, at their own risk and management do not accept the responsibility for any harm or injury to any member or guest, unless caused by negligence of the management, employees or agents of the company. No running, jumping or diving in the pools/ spa area is allowed.
H - Cars parked in the club car park or elsewhere on the premises of the club and all contents in them are left at the owners own risk and the club will accept no liability for loss or damage in respect thereof, unless caused by negligence of the management, employee or agents of the company.
I - For security reasons, members and guests are asked to store personal belongings and valuables in the lockers provided. Lockers are provided on a daily basis only and items left overnight will be removed from the lockers and retained for a reasonable period of time appropriate to their value and will be subsequently disposed of by management.
J - All members and their guests must take a small towel into the club when working out in order to wipe down equipment as courtesy to the next user.
A - The management reserve the right to use any individual or group photographs of members and/or guests for press or promotional purposes
B - The management may from time to time wish to show potential members or others around the club and allow them to use the club facilities on a trial basis and reserve the right to do so.
C - The clubs normal hours of operation and the hours in which any facilities within the club are available to members are obtainable from the company upon request. The club operates peak and off-peak time which are subject to change from time to time. The management reserves the right to close the club or adjust the hours for the purpose of cleaning, decorating, repairs or for special functions and holidays. The management shall endeavour to give reasonable notice of any lengthening or shortening of such hours.
D - The management reserve the right to hold private functions in parts of the club from time to time and will advise members in advance to accommodate such functions.
E - The failure of the management or the company to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
